Summary / Zusammenfassung The human right to health has been recognized by a significant number of international human rights institutions governing the conduct of states, organizations, and individuals. But this is not to say that there is complete agreement about the nature of such a right or its substantive scope – which is to say, its definition. This project is thus meant to address this gap by critically assessing the foundation of a human right to health. It is meant to be neither a historical nor a doxographical but rather an argumentative essay which tries to critically assess and develop an account of health as a human right. In doing so, it shall comprise the following components:
1) A justification of the concept of health and the morality of the human condition that we call 'health'.
2) A justification of the concept of human rights; this concept has to explained with reference to a) what we mean by '(human) rights', and, as rights and duties are an inseparable couple, also by 'duties' (in this respect I understand a human right as moral right, i.e. a pre-positive and pre-conventional right), and b) what we mean by 'human (rights)' (i.e. what is so special about the human being that we grant her moral rights).
An explanation will be provided how these two concepts are linked and which corresponding rights and duties arise for whom.
