Title / Titel Classical antiquity, natural law, and natural rights in the "De jure belli ac pacis libri tres" of Hugo Grotius
PDF Abstract (PDF, 14 KB)
Original title / Originaltitel Antike, Naturrecht und natürliche Rechte in den "De jure belli ac pacis libri tres" des Hugo Grotius
Summary / Zusammenfassung The eminent Dutch natural law thinker Hugo Grotius (1583-1645) has founded his natural law system, as it is set forth in his seminal "De jure belli ac pacis libri tres", on a vast mass of classical concepts and examples. Yet the influence exerted by classical antiquity on Grotius' natural law has never been thoroughly investigated. The dissertation shall try to show why it is that Grotius avails himself of the works of ancient philosophers, historians, poets, and jurist, how he uses their testimonies, and what consequences his use of classical antiquity brings about. In an attempt to gauge the impact classical sources had on the "De jure belli ac pacis libri tres", it shall be argued that Grotius' use of certain classical concepts enabled him not only to consolidate his natural law system on a secular basis, but also to constitute a doctrine of subjective, individual natural rights.
